2. Data Controller

The personal data we process may include:

  • Contact information, such as your name, job title, postal address (including your home address, if provided), work address, phone number, mobile phone number, and email address.
  • Additional information processed in the context of a contractual relationship with us or voluntarily provided by you, such as identity documents, instructions given, payments made, date of birth, personal identification number, video recordings, photographs.
  • In the context of the services provided, we may also collect and process special categories of personal data, such as union membership data, health data.

4. Legal Grounds for Processing Personal Data

Any processing of your personal data will be based on one of the following legal grounds:

  • The conclusion or execution of a contract to which you are a party. Please note that we cannot accept you as a client if you do not provide the necessary data.
  • Compliance with a legal obligation of the Data Controller.
  • The legitimate interests of the Data Controller or a third party (e.g., when processing is necessary for the execution of a contract to which your organization is a party), unless your fundamental rights and freedoms outweigh these interests.
  • Your consent.

For special categories of data, processing will be conducted if, in addition to a general legal basis for data processing, one of the following specific conditions for processing is met:

  • We have a legal obligation to process these categories of data.
  • Processing is necessary for establishing, exercising, or defending a legal claim.
  • There is a legitimate interest in processing the data.
  • Consent has been obtained from the data subject.

5. Purposes of Processing Your Personal Data

We may use your personal data for the following purposes (“Permitted Purposes”):

    • Managing and administering the contractual relationship with our clients and suppliers.

    • For the purpose of complying with court decisions and exercising and/or defending our rights and interests – Art. 6(1)(c) GDPR.
  • Management of our activities
    • Processing necessary for the proper and efficient management of our activities, e.g., costs, maintaining a database of our contractual partners with a legitimate interest – Art. 6(1)(f) GDPR.
    • Analyzing and improving our services and communications to you, including (as we have a legitimate interest in continuously improving our services) conducting client satisfaction surveys regarding our services – Art. 6(1)(f) GDPR.
    • Based on your consent, we may send you various communications through the channels you have approved to keep you informed about the latest developments in the legal field, announcements, and other information regarding the Controller’s services, products, events, and projects, references, or other informative materials – Art. 6(1)(a) GDPR.
    • Also based on your consent, we process personal data to offer you a position within the Controller following recruitment activities we organize – Art. 6(1)(a) GDPR.

6. Disclosure of Your Data

We may disclose your personal data to other lawyers (including other professionals we collaborate with in providing services) and legal specialists (including mediators, intellectual property advisors), consultants, or experts involved in the cases we manage and the services we provide, judicial or arbitration authorities, as well as other public authorities, entities indicated by you, parties involved in your case (which could be our client or a third party involved), or other entities in the context of providing the Controller’s services (such as: insurance service providers, cloud service providers, telephony, accounting, email services, etc.).

7. Transfer of Your Personal Data Abroad

We may transfer your personal data to countries within the European Economic Area or to countries recognized by the European Commission as providing an adequate level of personal data protection, if this transfer is necessary for processing in accordance with the Permitted Purposes described above.

We will ensure that these international transfers are carried out with appropriate safeguards as required by the General Data Protection Regulation (EU) 2016/679 or other applicable legal provisions. 8. Updating Your Personal Data

If any of the personal data you have provided to us changes, such as if you change your first name, last name, or email address, or if you wish to cancel any request made to us, or if you become aware that we hold any incorrect personal data about you, please contact us by email at: office@safetyjob.ro

We will not be responsible for any loss resulting from incorrect, unauthenticated, insufficient, or incomplete personal data you provide.

9. How Long Do We Retain Your Personal Data?

The Controller has implemented technical and organizational measures to organize the process and specific criteria for retaining your personal data (including according to our archiving procedures).

We will cease processing personal data when it is no longer reasonably necessary for the Permitted Purposes, or when you withdraw your consent (if applicable) and (i) there are no legitimate and compelling reasons justifying further processing by the Controller (including the Controller’s legal obligation to continue storing the data) that outweigh your interests, rights, and freedoms or (ii) if the data is no longer needed for the establishment, exercise, or defense of a legal claim.

Thus, we will retain your data for the entire duration of the contract plus an additional period of 5 years, starting from the year following the calendar year in which we completed the provision of our services, necessary to ensure that we can defend and exercise our rights in court if applicable, unless another legal retention period is specified.

10. Your Rights Regarding the Processing of Personal Data

Subject to certain legal conditions, you have the following rights concerning the processing of your personal data:

  • The right to be informed and access a copy of the personal data we hold about you.
  • The right to rectify any incorrect or incomplete personal data.
  • The right to erasure (“the right to be forgotten”).
  • The right to restrict processing.
  • The right to data portability, which allows you to receive a copy of the processed data in an electronic format and to transfer it to another entity indicated by you.
